Business Associate Agreement (BAA)

A Business Associate Agreement (BAA) is mandatory under the Health Insurance Portability and Accountability Act (HIPAA) whenever a contract is awarded where the contractor provides functions, activities, or services involving the use and/or disclosure of protected health information (PHI). For BAA language, see the Privacy Office Contract Language page. This page links to standard BAA language to be used for Military Health System (MHS) contracts other than Defense Health Agency (DHA) contracts. See the second heading, "HIPAA-Compliant Business Associate Agreement (BAA) for the MHS." The first heading, "DHA Standard Contract Language," links to language to be used in contracts awarded by or for DHA.

“On October 1, 2013, the Department of Defense established the Defense Health Agency (DHA) to manage the activities of the Military Health System. These activities include those previously managed by TRICARE Management Activity (TMA), which was disestablished on the same date. During the next several months, all TMA websites will change to reflect the new DHA. We appreciate your patience during this transition."
