Records Freeze

A records freeze is any action or event that will prevent the lawful destruction of records. Examples include:

  • Litigation
  • Updating a records control schedule
  • Re-processing, re-engineering
  • Disasters

In the Event of a Records Freeze:

  • Halt the destruction of all record material immediately
  • Work with the responsible parties to identify and narrow the scope of material affected
  • Address the records management issues that will arise from a "freeze," such as space
  • Records that could (and should) have been destroyed prior to a "freeze" must now be retained. If the records control schedule (Administrative Instruction 15) was not followed and record material still remains on hand past its disposition date, it may not be destroyed until the freeze has been lifted

Responsive Documents

  • Records freezes are not only limited to information that constitutes the legal definition of a “record,” but may also include drafts, working papers, and other non-record material, regardless of media
  • Should an office have responsive documents that do not necessarily meet the criteria of a Federal record, the documents still must be retained
